Use of our consulting services is governed separately by the applicable engagement agreement or statement of work entered into with Tideline Insights.

1. Acceptance of Terms

By accessing this website — whether by browsing, submitting an inquiry, scheduling a call, downloading any content, or otherwise using any feature of this site — you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with and be bound by these Terms in their entirety. These Terms apply to all visitors, users, and prospective or current clients.

Your continued use of this website following any posted updates to these Terms constitutes your acceptance of the revised Terms. If you do not agree to any part of these Terms, your sole remedy is to discontinue use of this website.

2. About Tideline Insights

Tideline Insights is a sole-proprietor ITSM consulting business owned and operated by Ryan Holzer, based in Fort Myers, Florida. We provide IT Service Management consulting, training, advisory, and related services to businesses and organizations nationwide. These Terms apply to the public-facing website and any pre-engagement communications. Formal consulting engagements are governed by a separate written agreement between Tideline Insights and the client.

3. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, icons, images, page layouts, frameworks, methodologies described, written content, video, audio, and the overall design and compilation of the site — is the exclusive property of Tideline Insights or its licensors and is protected by United States copyright, trademark, and other applicable intellectual property laws.

You may view, print, and share individual pages of this website for personal, non-commercial, informational purposes only, provided that you do not modify the content and that all copyright and proprietary notices are preserved. You may not reproduce, republish, distribute, transmit, display, sell, license, adapt, or create derivative works from any content on this site — in whole or in part — without the prior written permission of Tideline Insights.

References to third-party names, trademarks, or frameworks (such as ITIL®) are for descriptive purposes only. ITIL® is a registered trademark of PeopleCert Group.

4. Permitted Use of This Website

You are permitted to use this website to learn about Tideline Insights, explore our services, submit genuine business inquiries, schedule a discovery call, and access publicly available content for legitimate informational purposes. All use must be lawful, respectful, and consistent with these Terms.

It does not constitute professional consulting advice, legal advice, financial advice, or any other form of professional counsel specific to your organization’s situation.

7. Consulting Services & Engagements

A formal consulting engagement is established only when both parties have executed a written agreement, engagement letter, or statement of work that defines the scope, deliverables, timeline, fees, and other material terms.

Tideline Insights reserves the right to decline any engagement at its sole discretion, including after an initial discovery call, without obligation or explanation. Submission of an inquiry does not guarantee the availability of services or the commencement of any engagement.

All fees, payment terms, confidentiality obligations, deliverable ownership, termination rights, and remedies related to paid engagements are governed exclusively by the applicable written engagement agreement. In the event of any conflict between these Terms of Use and a signed engagement agreement, the engagement agreement controls with respect to the services covered by that agreement.

8. Results & Outcome Disclaimers

Tideline Insights makes no representation, warranty, or guarantee that any specific result, outcome, improvement, cost saving, efficiency gain, or other benefit will be achieved through use of our consulting services. Published metrics are based on prior client results and are shared in good faith as examples of what has been accomplished. They do not constitute a promise or projection for any prospective client.

Consulting outcomes depend heavily on factors within the client’s control, including but not limited to leadership commitment, team participation, organizational culture, pre-existing process maturity, technology environment, staff availability, and willingness to implement recommended changes. Tideline Insights is not responsible for outcomes that fall short of expectations where the contributing factors are within the client’s control or where recommended actions were not fully implemented.

9. Use of AI & Technology Tools

In the course of delivering consulting services, Tideline Insights may utilize a variety of technology tools — which may include artificial intelligence and machine learning-based tools — to support research, analysis, documentation, content development, and operational efficiency. The use of any such tools is at the sole discretion of Tideline Insights and is intended to enhance, not replace, the professional judgment and expertise applied to each engagement.

Tideline Insights exercises care to avoid inputting client-confidential or personally identifiable information into third-party AI platforms or tools that do not provide adequate data protection. However, clients are responsible for clearly identifying any information they consider confidential prior to sharing it during an engagement. If you have specific requirements or restrictions regarding the use of AI tools in connection with your engagement, please raise these in writing before the engagement commences so that appropriate provisions can be included in the engagement agreement.

No AI-generated content delivered as part of a consulting engagement is represented as a substitute for professional judgment. All recommendations, frameworks, and deliverables provided by Tideline Insights reflect the professional review and assessment of Ryan Holzer, regardless of the tools used in their preparation.

10. Vendor & Tool Neutrality

Tideline Insights maintains no paid referral arrangements, reseller agreements, affiliate relationships, commissions, or financial incentives of any kind with any software vendor, platform provider, or technology company. Any tool, platform, or technology recommendation made in the course of a consulting engagement is made solely on the basis of fit for the client’s specific environment, needs, and goals — not on the basis of any commercial relationship or financial benefit to Tideline Insights.

Where Tideline Insights references specific third-party products or services on this website or in engagement materials, such references are for illustrative or descriptive purposes only and do not constitute an endorsement, partnership, or recommendation specific to the reader’s situation. Clients should conduct their own due diligence before selecting or purchasing any technology solution.

If this policy changes in the future and any referral or affiliate arrangement is established, it will be disclosed prominently on this website and in applicable engagement materials prior to any affected recommendation being made.

11. Force Majeure

Tideline Insights shall not be liable for any delay, disruption, or failure to perform obligations under these Terms or any consulting engagement that results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters (including hurricanes, floods, or other severe weather events), fire, pandemic or public health emergencies, power or internet outages, cyberattacks or infrastructure failures beyond our control, civil unrest, government actions or orders, labor disruptions, or any other event that could not reasonably have been anticipated or prevented.

In the event of a force majeure occurrence, Tideline Insights will make reasonable efforts to notify affected clients promptly and to resume performance as soon as reasonably practicable. Obligations affected by a force majeure event will be suspended for the duration of the event without liability. This section does not excuse payment obligations for services already delivered prior to the force majeure event.

Formal confidentiality obligations, including mutual non-disclosure provisions, are established through the signed engagement agreement. If you require a standalone non-disclosure agreement prior to sharing sensitive business information, please request one before proceeding with detailed disclosures.

Nothing shared on this public website by Tideline Insights — including case study outcomes, service descriptions, or methodology summaries — contains confidential client information. All client-identifiable information is anonymized or shared only with explicit written consent.

15. Disclaimers & Warranties

This website and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Tideline Insights expressly disclaims all warranties, including but not limited to:

In no event shall the total aggregate liability of Tideline Insights to you for all claims arising out of or related to your use of this website exceed the greater of (a) $100 USD or (b) the total fees actually paid by you to Tideline Insights in the three calendar months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.

You agree to indemnify, defend, and hold harmless Tideline Insights and its owner(s), representatives, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of any applicable law, regulation, or third-party right, including intellectual property or privacy rights.
  • Any false, misleading, or inaccurate information you submit through this site.
  • Any unauthorized use of content from this site.

Before initiating any formal legal action, you agree to contact Tideline Insights in good faith at ryan@tidelineinsights.com and allow a reasonable opportunity (no less than 30 days) to resolve the dispute informally. If informal resolution is not achieved, any unresolved dispute shall be subject to binding arbitration administered under the rules of the American Arbitration Association (AAA), with proceedings conducted in Lee County, Florida, unless both parties agree otherwise in writing.

Notwithstanding the foregoing, Tideline Insights reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information without being required to post a bond or other security. You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.

20. Severability & Entire Agreement

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Tideline Insights with respect to your use of this website and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the same subject matter. In the event of any conflict between these Terms and the Privacy Policy, these Terms control except with respect to matters expressly governed by the Privacy Policy.

No waiver by Tideline Insights of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of that right or provision.

Tideline Insights reserves the right to update or modify these Terms at any time. Changes will be posted to this page with a revised “Last updated” date and version number.
